Lebanon expected to press charges against Australian mother

A state prosecutor in Lebanon is expected to file kidnapping charges against an Australian woman, an Australian TV crew, and others Monday for attempting to take the woman’s two children away from her Lebanese ex-husband and bring them back to Australia.

Sally Faulkner, along with four Australians, two Britons, and two Lebanese, was brought into police custody last Thursday after a botched attempt was made to snatch Faulkner’s five-year-old daughter and three-year-old son from their paternal grandmother as she took them to school in Beirut.

Faulkner said her ex-husband, Ali Al-Amin, moved the children to Lebanon without her permission.

The detainees include prominent Australian TV presenter Tara Brown and her crew from Channel Nine TV. A reporter from the station said in an interview broadcast Thursday that the crew was there to cover the story for 60 Minutes.

Michael Brown said it was a “risky operation, a risky story — this desperate Australian mum trying to get her two children home,” but said the crew was prepared for the difficulties.

A judicial official, speaking on the condition of anonymity Monday because he was not authorized to speak publicly, quoted state prosecutor Claude Karam as saying: “Their files will be studied in preparation of charging them in the case regarding the kidnapping of two underage children, in contravention to Lebanese law.”

The children’s grandmother, Ibtisam Berri, said she and a domestic worker were taking the children to school last Wednesday when two men jumped out of a parked car and took the children away. She said a cameraman was filming the scene from the car.

At least one of the Britons is being held on suspicion that he planned to smuggle the children out of Lebanon on his boat, docked in a private Beirut hotel, police officials said.

The authorities returned the children to Al-Amin, who told a local TV station that he would not sue his former wife. “She is the mother of my children … if I were her I would have done the same,” he told LBC last Thursday.

He told Al Jadeed TV that Faulkner and Australian security agencies knew he was leaving Australia with the children and denied kidnapping them from their mother.

        Kids (assuming they have not been brutilized) love both parents. And the different rolls of each.
        If there was a divorce, then there was a ruling about the kids … courts recognize their rights and try to make it as easy on them as possible. A ruling is legal. So what was the ruling about the sharing?

            Perhaps the usual ‘lip-service’ for an older female would be a ‘play’ for the crowd … notes for a lawyer to use … even Reasonable notes the ‘rules’ for females are horrible, and I have seen it well with the ones I know. Don’t give me the ‘Grandmother’ song. Did anyone worry about a Grandmother’s feelings for the boy permanently brain-damaged by falling lead in a playground? Really? I don’t even think I saw a statement from the Mother – the Father was ‘interviewed’. Is treatment for life supplied for free??
            (one supposes they passed that off as an ‘act of god’ … did we even hear a ‘Sorry’?)
            They bumped Grandma aside as they grabbed the kids … she was swinging her purse at the car as it drove away – didn’t seem damaged except psychologically. And from what I’ve seen, that’s way down on the list of items of ‘care’ for a female in Lebanon.
            The ‘news item’ about the bomb that was targeting an army bus in Tripoli talks about wounded soldiers … and a pic shows firetrucks at the scene putting out a fire. It does not mention the 4 women and their orphan boy who were almost killed when the house wall blew in, or that a whole family history went up in flames, or that they stood on the street for almost 2 days after, until ‘rescued’ by another female who had some sympathy.
            There is no ‘favour’ for a female, even a Grandmother.

            What really concerns me as a mother is what is he going to tell his 2 children once they grow up and start asking questions. Some people want the mother behind bars with maximum sentence. If she gets that means she will spend 20 years maybe in prison for trying to recover what was taken from her. The children will hate him, the grandparents and the country. The children now will be raised with hatred towards the mother cause she is not there with them and because she tried to “hurt” them by trying to get them back under her love and protection. No grandmother is good enough to raise children unless the mother of course is proven to be incapable of raising her own children. The bullshit we have been served that she has put the children in risk to get retrieve them from that specific area applies also to the father and grandmother they mentioned that the area is patroled by armmed men and it they could of been killed if they start shooting left and right but at the same time 41 years of civil war in Lebanon has killed so many innocent children walking their way to go to school. Now i really like to know how he and his family will explain to those children when they grow up why he took them from their mum and country so he can raise them between bombs and civil wars and cars loaded with explosives.

            Dad says, mother had no problem until payments stopped.
            She says she was duped.

            Besides there is no evidence the journos were even conducting a report, no video no documents.

            Luckily the child recovery agencies were able to provide thr police documented payments by the journos for yhe abduction, otherwise they would have gotten off scotch free. It could’ve been just a payout job, do this give us a story and take this it’s too early to tell.

            And seriously south beirut a hezballah stronghold, wtf there lucky to be alive. The dad is even refusing to press charges.

            I would say the status quo has changed … That island known in history as a prison for various nefarious types is not quite the same any more. And ’empires’ tended to utilize certain ‘peoples’ when they could get them – Too sad that the indigenous peoples were not seen as possible employees – but there’s a lot of respect for them after Crocodile Dundee.

            They keep telling us to be ‘aware’ of the local laws when doing the tourist thing.
            One would assume, therefore, that Lebanon has to go by a legal settlement made in Australia. The ‘kidnap idea is simply a stupid move … but probably by the time Leb Courts handle anything, the kids will be 18 and travelling as they wish, if they can find a job to cover the expenses.
            AND western ‘law’ had always favoured the female as the ‘protector’ of the child … it took a lot of work by loving Fathers to have those thoughts changed in Law here. Turns out it was not only males who were the ‘Bad Guys’. We work toward ‘equality’, after all. 😉

            Being the mother doesnt mean automatically you have the right of custody for children. Some fathers are better parents than the mother is. But in this case this is not the case we are not investigating if the mother was a suitable mother to raise those kids.

          29. Lebanon is not exactly a prime location to bring up young children when there is a much safer, and native home in Australia. Imagine that, no wars on their doorstep or car bombs or the dreaded Hezbullah militia bullying the whole country and crippling what is left of the government. Without the drama I would say the whole kidnapping routine was an act of desperation to remove her children from an unsafe country where the future is bleak. In all reality the grandmother would have ended up looking after the children the majority of the time anyways. There should be an international court decide what is best for the children, not some unfair and inefficient legal system in Lebanon.

            Did I say it wasn’t a crime? They practise it regularly, however. Ask a Turkish pilot, or some cyclists from some too-innocent cycling club. One can have a ‘law’ on the books, but ignore it .. just like road-speeds. I have noticed that some of the tribes treat the kidnapped victims very nicely until the ransom is paid. Usually they don’t cut off the heads.

            When a court in any country under the Hague convention gives custody to a parent (Can be arabic, can be asian, european or any other nationality) the other parent has to respect the court order. If someone from my country decides to desrepect that court order and they remove the kids from the person who has custody and run to our country to hide there wont be any place to hide. The police will catch them and return them back to the parent who has custody without excuses like the christian mother will make them christians or the muslim mother will make them muslims so this is a reason not to return the children to the parent who has custody. Plain and simple. Cannot be more simple i beleive. But in Lebanon is not that simple. I wonder why they do mix weddings though if religion is above everything else. In my world we consider childrens best interest and nobody in the right mind will tell me that excluding the mother from raising her children is to the best interest of the children.

            In my experience, over 3 generations, ‘Mom’ was around all the time … made the house rules, did most of the disciplining, decided meal-times, and ‘homework’ times. She was the one who said when kids could go out to play, and when they had to be back home. This was her ‘job’, and she was the ‘boss’. Kids relied on this for stability … although they didn’t think of it in that way … but ‘home’ was the ‘safe’ place to run to. Mom patched the wounds … with lots of love … but kids expected that level of input, because ‘Mom’ had always been there – from the beginning.
            ‘Dad’ went to work … usually before kids woke up … and only appeared a bit before dinner-time. Kids ran to Greet him – like a lost friend. Kids only had ‘Dad’ to interact with from that moment, and to tell him how their day had been, and what they had discovered or suffered from. Those moments were more necessarily ‘intense’ for the kids – because they could only get the ‘male love’ for a short time.
            Weekends were ‘better’ … Dad’s had time to ‘play’ too. Or take the ‘family’ to a special place. Exciting moments happened with Dad.
            Sometimes …. Dad had to remind kids to give ‘Mom’ a special hug for what she did, and had done as ‘Mother’, because they tend to expect all that, but ‘Dad’ is a little mystery.
            (When Dad yelled, they listened … hehehe … a special power. ;-))

But back to the case in Lebanon, it is clear that the ex husband had plans for his mother to be the primary care giver and she was ok with that. Just going by human nature. The children are simply too young in this case to have a say in the decision process even though the husband had already made plans to steal the kids first. I stand by the opinion that it was irresponsible of the husband to risk the lives of his children and their education and futures by forcing them to grow up in a war zone where he will be indoctrinated into good little Hezbullah.

          137. This is not about defending Lebanon. I defend the mother rights not the desperate crime she did. But she does have rights (in western countries anyways). What the husband did was not ok, how was the mother to see her kids again, ask nicely? He took the children with no intention of returning to Australia, and the mother did the only thing she could do, attempt to steal them back if she ever wanted to see them again. The best place for the children is with the mother in their native land where there are opportunities and a safe future, not some war zone where there is little chance of any normal future.

        The couple lived in Australia and Lebanon when they were married. He knows the muslim law in your country gives her no right to get her children back as Lebanon has not signed the Hague convention so no matter how this woman tries to get her children back as their mother, in your country the muslim law is above all law. You are blaming her for having a new partner while she was married, well 2 years they were separated and not 1 and she has every right to move on with her life if she wants to. Are you a mother? Are you married to a christian canadian? Imagine you go home to visit your family and he divorces you takes custody of your children and you cannot raise them anymore and then think again suggesting she goes on holidays to visit her own children.     Return of children abducted to or in Lebanon

    There are extreme difficulties in returning a child to the United States from Lebanon when retained by a Lebanese parent.

    Lebanon is not a party to the Hague Convention on the Civil Aspects of International Child Abduction.

    There are no extradition treaties between Lebanon and the United States.

    Under Lebanese law, Lebanese nationals may prevent their wives and children (even if they are American citizens) from leaving Lebanon.

    Lebanon does not recognize international parental kidnapping as a crime.

    Issues of child custody and divorce in Lebanon are generally decided in religious courts under religious law. Thus, if the father is a Sunni Muslim and the mother is a Christian the custody of their children will normally be decided by a Sunni Muslim court.

    One might petition a civil court to handle a custody case instead of a religious court. The issue would be whether the religious court has jurisdiction. It could take up to two years to have the civil court assume jurisdiction and a minimum of four to five years to have the case decided.

    Among Sunni Muslims, the father has physical custody of a daughter over the age of nine and of a boy over the age of seven. For Shia Muslims the father generally has physical custody at for boys at age 2 and for girls at age 7.

    If a father establishes that the mother is unfit or lacking good moral character, she will lose any right to the child. Muslim law requires a child to be raised in the Muslim faith, and if it were proven that a mother tried to raise the child as a Christian, she could be found unfit.

    Lebanon does not recognize dual nationality. American/Lebanese dual nationals who carry Lebanese papers will be treated as Lebanese nationals by security authorities.

    A child who is a dual American and Lebanese citizen would be bound by Lebanese law in the eyes of the Lebanese civil courts.

    The U.S. State Department cannot offer any real assistance even if there were a United States court order directing the return of the child from Lebanon.
